Aki Technologies, Inc. (“Aki”, “we” or “us”) is a mobile advertising company. We use our proprietary technology (our “Platform”) to offer advertising solutions to our clients. We provide this Privacy Policy to explain how we collect and use certain information. This Privacy Policy and the opt-out choices below apply to Aki’s mobile advertising products and services, including those provided through our Platform (collectively, our “Service”).

Website Information Collection. Aki is the sole owner of the information collected on our websites (a.ki and any other websites we may own or operate). The information may consist of both Personally Identifiable Information (“PII”) and Non-Personally Identifiable Information (“Non-PII”), and is collected in order to conduct business with current and prospective business clients. PII is information about a specific individual (i.e. name, contact information, or billing information) that is used to identify that individual. We do not sell or rent information collected via our websites to other parties, but we may provide it to third parties as necessary to conduct our business operations and to our customers for the performance of our Services, or we may disclose such information as otherwise described in this policy. Aki uses information collected on our websites to provide communicate with prospective clients, to establish advertiser and publisher accounts on our Platform, and otherwise as necessary to conduct our business. If you would like to review or request changes to PII that you have submitted through our websites, or would like to request that we not share your PII with third parties, please contact us using the information below.

Information Collected In Connection With Our Services. Aki collects Non-PII from across our Platform. This information, which may include anonymous identifiers associated with your mobile device (e.g., the Apple iOS IDFA or Android ADID), accelerometer and gyroscope data, and the location of your device (i.e. GPS or Wi-Fi data if you enable these services), does not identify you personally, and may come from such sources as your mobile web browser, or the apps that you use. We may also collect and/or use information collected by our business partners and shared with us, and information from third party providers. We use this Non-PII (including device advertising identifiers) in our Platform to perform a variety of tasks, such as improving the relevance of the ads, , limiting the number of times a specific advertisement is presented to the same mobile device (frequency capping), providing an advertisement to only certain types of mobile devices, or providing a report to a client on the number of its advertisements that were clicked. We may share this Non-PII with clients, vendors, and other companies with whom we conduct business, and as otherwise described in this policy. We may also use some of this information to provide interest-based advertising, as discussed more fully below.

Other Information Sharing. Aki may share non-PII with its affiliated companies and its business partners. We may disclose information, including PII, when in our sole judgment we are required to do so by law, regulation, or when such action is necessary to comply with a current judicial proceeding, a court order or legal process. Additionally, there may be times where we will need to disclose information to protect our system or our rights or to ensure your safety or the safety of others. We may also transfer all or some of the information discussed in this policy, in connection with a corporate merger, acquisition, partial or total sale of assets, bankruptcy, or any other corporate change.

Aki works with its clients to provide ads that are likely to be more interesting and more relevant to mobile device users. One way we do this is by collecting information that does not identify you personally (Non-PII), which may include things like mobile apps that you use, preferences that you may have provided to your app provider or to Aki (as in a survey), information collected by our partners and other third parties and shared with us, device identifiers, accelerometer or gyroscope data, or location information (i.e. GPS or Wi-Fi data if you have enabled those services). We may also link an identifier to additional information from other partners to provide us with some information about users’ likely interests.

Aki does not knowingly deliver or target ads except to mobile devices, so the best way for you to opt out of the use of information for interest-based advertising by Aki, is to follow these instructions:

Opt-Out Instructions

  • Android: You can reset your advertising ID at any time, right from the Ads section of the Google Settings app on your device. From the same app, you can also opt-out of targeted advertising based on the advertising ID by setting the appropriate ad tracking preference.
  • iOS: You can opt out of targeted advertising by turning on Limit Ad Tracking in your device’s settings menu (as of the date of this Privacy Policy, located at Settings > Privacy > Advertising) and by turning off Location Based iAds in your device’s System Services Menu (as of the date of this Privacy Policy, located at Settings > Privacy > Location Services > System Services).

Please note that while opting out limits Aki’s collection of information to serve you interest-based ads, it does not prevent you from receiving ads from Aki or third parties.

Websites. Our websites may contain links to other websites. Aki is not responsible for the privacy notices or practices of these third-party websites.

Ads. We may also provide ads that link to third-party sites, third-party apps, or other third-party content (collectively “Third-Party Content”). This Privacy Policy does not extend to Third-Party Content, or any services offered on or through Third-Party Content.

Aki emphasizes that this Privacy Policy does not address the practices or policies of its Platform and Service customers, nor of any website, mobile app, or other property on which ads are displayed through the use of the Aki Platform or Service.

The collection, retention, processing and other uses of data by Aki Platform and Service customers, whether or not in connection with the Aki Platform or Service, is governed by their own privacy policies and applicable laws, rules, or regulations. Aki does not control those activities, and if you believe that an Aki customer has collected or processed your information (either directly, or indirectly through a third party), you should contact them directly.

We may, on behalf of our Platform and Service customers and other partners, collect information from end users. This may occur, for example, if someone submits information in response to an ad that we provide on behalf of a Platform or Service customer. Such information may consist of PII, Non-PII, or both. In such situations, we collect the information and provide it to our customer, and it will be subject to that customer’s privacy practices.

As indicated above in this section, Aki customers use information according to their own privacy policies and applicable law and regulation. However, Aki provides the following types of data analysis functionality to its customers within the Aki Platform and Service:

  • Measuring the performance of advertising campaigns;
  • Measuring the performance of advertising displayed through publishers, web sites, mobile applications, and other properties;
  • Limiting the number of times a specific advertisement is presented to the same browser or mobile device (frequency capping);
  • Creating customized performance reports (for example, how well a particular advertisement is performing in a particular geographic region or among a particular demographic);
  • Improving the targeting or relevance of advertising to users; and
  • Aggregating the information collected for an Aki customer with other information provided by other Aki customers and information provided by third parties to undertake any or all of the foregoing activities.

Aki does not knowingly collect information from children under the age of 13. If you believe your child has provided Aki with personal information, and you would like to have the information removed, please contact us using the contact information below.

Aki takes reasonable steps to protect the security of information that we collect. To that end, we have designed and deployed hardware, software, and networking solutions in an effort to reasonably secure and protect access to our systems and data.

Aki may make changes to this Privacy Policy. If we make any changes to our privacy practices that we believe are material, we will post a revised Privacy Policy on this website.

If you are a natural person who is a California resident, as defined in the California Consumer Privacy Act of 2018 (the “CCPA”, then you are a “consumer” and this California Consumer Privacy Act Notice (“CCPA Notice”) applies to you and your personal information as defined in the CCPA (“personal information”).

Please note that we have to be able to verify your identity in order to comply with any of your requests to exercise your rights, and as we explain below, we collect limited categories of personal information that can be used to verify your identity.

NOTE: We use instantaneous data analysis based on information a user device provides to make our best estimate of what a user may be doing at the moment that an ad could be displayed to them, and serving an ad to them based on that information.  We don’t maintain any user profiles over time.

We do not knowingly collect or sell the personal information of minors under the age of 16.

1. Aki emphasizes that unless you have contacted Aki directly to provide us with your contact information (for example, through one of the means provided on this page or on our website marketing or contact forms), Aki does not know who you are.  Aki does not have any other way to identify any individual person using the information it collects on its web pages or through its mobile advertising service.  The closest that Aki can come is using your mobile device’s advertising identifier (more about that below) to identify that specific device.

2. Except in those limited cases where you have provided us with your contact information, when we fulfill your requests to exercise your rights under the CCPA, we’re really going to be providing you with information Aki has about one device at a time, deleting information about that one device, and stopping the sale of information about that one device.  That’s because we don’t know who you are – we only know things about that device based on the advertising identifier its operating system provides – so that’s all we can do.  If you change your device, reset/change your device specific advertising identifier or change certain information on the device to limit ad tracking, we will probably detect it as a new device, and will treat it accordingly.  We explain more about that below.

3. Aki provides its advertising services to its customers as a service provider.  That means that most of the personal information we have about devices belongs to our customers, not to us.  For data that falls in to this category, we are not be able to provide it to you or delete it.  We will try to provide contact information for the customers we determine to control your personal information.

4. You can send a request to Aki in order  to exercise any of your rights under the CCPA.  We will check our records to see if we have your contact information based on the email address you provide us in that request.  However, because our advertising services only know about devices through their operating system advertising identifiers, we will need your mobile advertising identifier in order to verify your identity and check those records.  Your mobile advertising identifier is assigned by your device’s operating system.

  • To find your mobile advertising identifier in iOS, download an app such as The Identifiers, My Device ID, or My TUNE Device.
  • To find it in Android, check the Ads section of the Google settings app on your device.
  • If your mobile advertising identifier is shown as a string of only zeroes, your device is already set to limit ad tracking by default.

Aki doesn’t generally or deliberately serve advertising except to mobile devices.

You can contact us through any of the methods below.  In addition to using these contacts to submit requests under the CCPA, you can also use them to ask questions or communicate concerns about our privacy policies and practices.

5. If you want to opt-out of us tracking your device to receive personal information from it, and providing personalized information to you, you can also use one of the following methods:

  • Android devices: You can reset your advertising ID at any time, right from the Ads section of the Google Settings app on your device. From the same app, you can also opt-out of targeted advertising based on the advertising ID by setting the appropriate ad tracking preference.
  • iOS devices: You can opt out of targeted advertising and tracking via mobile advertising identifier by turning on Limit Ad Tracking in your device’s settings menu (as of the date of this Privacy Policy, located at Settings > Privacy > Advertising) and by turning off Location Based Apple Ads in your device’s System Services Menu (as of the date of this Privacy Policy, located at Settings > Privacy > Location Services > System Services).
  • Web browsers:  You can disable all cookies (which will affect the functionality of most websites), or only third party cookies, which may affect the functionality of some websites.  Most advertisers use third party cookies.  Then if you know which cookies you want to delete, you can delete those, or you can delete all of your cookies (which again, will affect the functionality of most websites— for example, you may lose your login status). You have to repeat the process for each browser you use.  From our perspective, each browser is a separate device and we do not use, track, or store any data from mobile browsers.

6. If you get a new device or browser, reset your mobile advertising ID, or delete your cookies stored by a browser, we will  not recognize the device or browser as one that has opted out.  We also may not be able to recognize that we collected personal information from that device before you made the change, so we won’t be able to tell you anything about the personal information we collected from that device or browser before the change.

The following two options are available, in compliance with the CCPA and its regulations, for making your request to opt out of the sale of your personal information, access it, or delete it:

Aki operates as a service provider when collecting and processing information to provide our advertising services, so we may not be able  to provide you with personal information that belongs to our customers.  We do collect and process personal information in rare instances, such as collecting information from our website and webforms.  By submitting your personal information below to make your request , the  personal information will be collected and retained for the duration required by the CCPA, used only to respond to your request and to keep the legally-required records.

By submitting a request to us, you represent to us that you are (or you are an authorized agent of) the person and the owner of the device you identify in the request.  The CCPA requires us to verify that personal information is being released to the correct party for whom the information is being requested.  In order to ensure that we only provide personal information  to the correct person, we may request that you provide screenshots of mobile advertising identifiers on your device.  This allows us to authenticate you as the owner of the device in making the request.  We may also contact you via email at the address you provide to authenticate you are the owner of the email address being used.   

If you do not provide the mobile advertising identifier of your device, including the screenshot, which can be found using the methods described above, we will limit our search and response to your request to our marketing information categories as outlined above.
